General Terms and Conditions for Weddings (as of January 2021)

The client undertakes to read these Terms and Conditions carefully and acknowledge them in full. The following Terms and Conditions apply to all bookings. They are deemed accepted unless an objection is raised immediately.

General Provisions

The subject of the agreement is the provision of services by the sole proprietorship Anna Limacher Make-Up Artist & Photography for the contractually agreed purpose. The contractual relationship is established exclusively between Anna's Bride  and the client.

 

1. Booking

The booking is considered accepted by the client once the quotation has been marked as “Accepted” via the email form or written confirmation has been provided.

2. Trial Appointment

A deposit of CHF 320 is due before the trial appointment. This amount must be paid by bank transfer or in cash at the trial appointment.

3. Cancellation of the Trial Appointment

The trial appointment may be cancelled free of charge up to 14 days before the appointment. After this deadline, Anna's Bride may charge a cancellation fee of CHF 120.

4. Cancellation of Wedding Day Services

The client may cancel the services free of charge up to 30 days before the wedding date. Cancellations made less than 30 days before the wedding date will be charged at 50% of the agreed cost. Payment is due within 15 days.

4.1 Cancellation of Make-Up and Other Services

Appointments must be cancelled at least 24 hours in advance. Otherwise, the full price of the booked service will be charged. An appointment confirmed either in writing or verbally constitutes a booked service.

5. Cancellation by the Client

The client may terminate the contractual relationship at any time. No refund may be claimed for services already provided by Anna's Bride before the termination date. Otherwise, clauses 3 and 4 apply.

6. Cancellation by Anna's Bride

Anna's Bride is entitled to terminate the agreement at any time and without notice if at least one of the following conditions is met:

• The client fails to fulfil their payment obligations despite receiving a payment reminder from Anna's Bride

• The client fails to fulfil their obligations to cooperate (see clause 8).

 

7. Services

Annas' Bride undertakes to advise the client conscientiously, comply with hygiene standards and provide the contractually agreed services. Anna's Bride undertakes to fulfil the commitments set out in the agreement.

If Anna's Bride is unable to provide the services due to illness or circumstances beyond its control, it will make every effort to find a suitable replacement. In such cases, Anna's Bride shall not be liable for any additional costs or losses that may arise.

If the client does not agree to the replacement, they may withdraw from the agreement. No cancellation fees will apply.

 

8. Client’s Obligations to Cooperate

The client is required to communicate any changes to the location and time.

The client undertakes to provide Anna's Bride with information relevant to the provision of the services. Any allergies, intolerances, illnesses or inflammatory conditions, such as herpes, conjunctivitis or similar conditions, must also be disclosed in advance so that, following consultation with a doctor, it can be assessed whether the styling may proceed.

 

9. Payment Reminder Fees

If an invoice is issued and remains unpaid after the specified payment deadline, a payment reminder fee of CHF 40 will apply.

 

10. Liability

In the performance of the booking, Anna's Bride shall be liable only for gross negligence or intentional misconduct in respect of personal injury or bodily harm caused to third parties by the make-up artist, and damage arising from a breach of an essential contractual obligation. This also applies to any persons or assistants engaged to fulfil its contractual obligations.

No liability is accepted for allergic reactions to the products used.

 

11. Attribution

Anna's Bride is entitled to be credited as the creator whenever its work is used publicly.

 

12. Use of Images

With the client’s consent, Anna's Bride is entitled to use photographs, films, analogue and digital media, and any prints or copies thereof, for which it has provided services, for its own promotional purposes. This includes, in particular, distributing them, publishing them online or displaying them as examples of its work.

In such cases, the client is also responsible for ensuring that the persons depicted consent to the aforementioned use by the make-up artist.

Severability Clause

Any supplementary agreements or agreements deviating from these Terms and Conditions must be made in writing.

If any provision of the agreement or these Terms and Conditions becomes invalid, this shall not affect the validity of the remaining provisions or the agreement. The invalid provision shall be replaced by a provision that comes as close as possible to its intended purpose. The same principle applies to any gaps in the agreement.
